PRIVACY POLICY

Foundry Legal, LLP (“Foundry Legal”) respects your privacy and is committed to protecting it through this Privacy Policy (this “Policy”). This Policy describes the types of information Foundry Legal may collect from you or that you may provide when you visit the website www.foundry.legal (the “Site”).  To the extent that any of the particular services or materials include specific privacy policies, those policies will take priority over this Policy.

This Policy describes how your information will be treated as you use the Site and services, including Foundry Legal’s practices for collecting, using, maintaining, protecting, and disclosing that information. This Policy does not, however, apply to information provided to Foundry Legal offline, in the course of our attorney-client relationships or which is protected by confidentiality, attorney-client privilege, or any other similar protection. This Policy does not create an attorney-client relationship with visitors to the Site.

Please read this Policy carefully to understand our policies and practices regarding your information. If you do not agree with our policies and practices, your choice is not to use the Site. By accessing or using the Site, you agree to this Policy. This Policy may change from time to time. Your continued use of the Site after Foundry Legal makes changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates. 

Information Foundry Legal Collects About You

You may provide, and Foundry Legal may collect, certain information by visiting or by completing various forms found on the Site, such as a contact form, completing online questionnaires, or signing up for our newsletters. You may also provide us with personal information if you communicate with us by e-mail, telephone, postal mail, or electronic file transfer services.  This includes both personal information (information that may individually identify you and/or a device that you use), information that individually does not identify you, and/or information about your internet connection, the equipment you use to access the Site, and usage details.

This information may include your IP address, browser type, referring and exit pages, operating system, and dates/times of page views, browser type (to protect against spam or abuse of the Site), “clickstream” information, and information collected through cookies.  Foundry Legal uses reCaptcha v3, which is a product of Google and subject to the Google Privacy Policy and Terms of Use.

We collect this information directly from you when you provide it to us and automatically as you navigate through the Site.   Also, if you provide information to a partner of Foundry Legal, such as to register for an event, that partner may provide your information to Foundry Legal pursuant to the terms of that agreement.

How We May Use Your Personal Information:

• to fulfill the purpose for which you provide it, such as providing you with publications, information or other services that you request from Foundry Legal;
• to invite you to, register you for, or remind you about our events;
• to add you to mailing lists and send you marketing materials we believe may be of interest to you;

• to verify your identity, and to prevent spam and abuse on the Site;

Your Rights

Under certain circumstances, you may have the right to request access to and correction or deletion of your personal information, to restrict or object to the processing of your personal information, and to the right to data portability. You may also have the right to complain to a competent supervisory authority if you feel that we are not complying with our data protection obligations. 

Foundry Legal will provide you access to your personal information so that you may review or update it. Foundry Legal will also use reasonable efforts to remove your personal information from the Site at any time upon your written request to info@foundry.legal.

We retain information that is collected through the the Site only for as long as needed for the purpose for which it was provided, or as otherwise required for our legitimate business purposes. Your information may be retained for longer periods if there are valid legal grounds for doing so, including for example, if required by law or court order, or to defend ourselves against or to pursue legal claims.

Foundry Legal does not share your personal information with third parties for those parties’ own direct marketing purposes; we only share your data with third parties if those parties need that information to help us provide our services. The Site may contain links to websites not operated by Foundry Legal. Foundry Legal is not responsible for the privacy practices or the content of such third-party websites, including those websites that we use for services such as scheduling appointments or accepting payments. Security

Foundry Legal has implemented measures that are appropriate to protect your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, the transmission of information via the internet is not completely secure. Although Foundry Legal does its best to protect your personal information, we cannot guarantee the security of all personal information transmitted to the Site.

Legal Basis for Processing Your Personal Information

Foundry Legal relies on various legal bases when we process your personal information. These legal bases depend on what personal information Foundry Legal processes and for what purpose. Under the European Union General Data Protection Regulation (“GDPR”), the processing activities described in this Policy are based on: (i) consent (Article 6(1)(a)), to the extent personal information is collected by Foundry Legal with your permission when you voluntarily provide it, including, for example, information you provide when you join a Foundry Legal mailing list or when you register for an event; (ii) contract (Article 6(1)(b)), when, for example, you provide personal information via an engagement; and (iii) legitimate interest (Article 6(1)(f)), when, for example, Foundry Legal uses personal information to monitor and improve the Site and our services, to protect and defend our rights or those of our clients’ or other users of the Site, and to promote our business.

Foundry Legal may disclose aggregated information that does not identify any individual without restriction. Foundry Legal may disclose personal information we collect, or you provide, as described in this Policy:

• if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Foundry Legal, our clients, or others.

This may include, for example, publications produced by third parties or events that are held or sponsored by third parties.

Children’s Privacy

The Site is not intended for children under 18 years of age and Foundry Legal does not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on the Site or on or through any of the features. If Foundry Legal learns that it has collected or received personal information from a child under 18 without verification of parental consent, it will delete that information. It is Foundry Legal’s policy to post any changes we make to this Policy on this page. If Foundry Legal makes material changes to how we treat our users’ personal information, we will notify you by email to the email address specified in your account or through a notice on the Site home page. You are responsible for ensuring Foundry Legal has an up-to-date active and deliverable email address for you, and for periodically visiting our Site and this Policy to check for any changes.
